Terms of Use — NuFocco

Effective: from March 1, 2026

These Terms of Use govern access to and use of NuFocco (iOS/Android apps, web version, and related services), collectively the "Service". By creating an account, accessing, or using the Service, you acknowledge that you have read and agree to these Terms.

1) Service Provider

2) Eligibility

The Service is intended for users 18 years of age or older. By using the Service, you represent and warrant that you have the legal capacity to accept these Terms.

3) Service Description

NuFocco is a health, nutrition, and fitness platform that may include, among other features:

• Registration/login and profile management
• Goals and tracking (e.g., weight, measurements, and progress)
• Meal planning, meal logging, and recipes
• Workouts, exercises, workout logging, and history
• Challenges, achievements, and gamification features
• Social features (feed, posts, likes, comments)
• Messaging/chat
• Educational content
• Notifications and reminders

The Service may operate on a freemium model, with free features and premium features available through subscription.

4) Account, Security, and User Responsibility

• You are responsible for keeping your credentials secure and for all activity on your account.
• You agree to provide truthful and up-to-date information.
• Fake profiles and impersonation (including using public figures' names to impersonate them) are prohibited. The Service is intended for real profiles of actual individuals.
• We may adopt protective measures, such as additional verification and rate limiting, when necessary.

5) Rules of Use and Conduct (Community)

By using the Service, you agree not to:

• Engage in harassment, threats, bullying, intimidation, or stalking
• Post hateful, discriminatory, or violence-inciting content
• Post sexual content involving minors, sexual exploitation, or any illegal content
• Disclose personal information of third parties without authorization
• Post spam, fraud, scams, phishing, or deceptive practices
• Use the Service for illegal activities
• Violate copyrights, trademarks, or other third-party rights
• Attempt to bypass security, reverse engineer, exploit vulnerabilities, or interfere with the Service's operation

Moderation: We may review, remove content, and apply measures such as hiding/removing posts, limiting features, temporary suspension, and account termination. For questions or reports, contact: contato@nufocco.com.

6) User Content

The Service may allow you to submit/publish content (text, photos, videos, comments). You represent that you have the necessary rights to the content you publish. You grant NuFocco a non-exclusive, worldwide, royalty-free license for the duration necessary to host, store, reproduce, adapt (e.g., resize media), display, and distribute such content to operate the Service (e.g., feed display).

7) Professionals (Nutrition/Training)

The Service may allow interaction with professionals. Engagement of professionals is made directly between user and professional. The professional may view data only when you allow/authorize within the Service. The Service does not replace in-person professional guidance when necessary.

8) Subscriptions, Payments, Cancellation, and Refunds

8.1 Freemium Model

NuFocco may offer free features and premium features through subscription. Plan details (price, frequency, benefits) are displayed in the app/service at the time of purchase and may vary by platform and country.

8.2 Subscriptions via Apple and Google

When a subscription is made through the Apple App Store or Google Play, the terms and policies of those stores also apply.

• Auto-renewal: when applicable, the subscription renews automatically until canceled.
• Cancellation: typically done through your store account settings (Apple/Google).
• Refunds: processed according to Apple/Google rules.

8.3 Web Subscriptions/Payments

If the Service offers web purchases/subscriptions, payments may be processed by providers (e.g., Pagar.me/Stripe), subject to the respective provider's terms.

9) Intellectual Property

The Service, including brand, name, visual identity, texts, content, screens, software, and features, is protected by intellectual property laws. You may not copy, modify, distribute, sell, rent, sublicense, or commercially exploit the Service (or parts thereof) without authorization.

10) Privacy and Data Protection

Personal data processing is governed by NuFocco's Privacy Policy. By using the Service, you acknowledge that you have read and agree to the applicable Privacy Policy.

11) Medical Disclaimer and Use at Your Own Risk

NuFocco does not replace individualized medical/professional diagnosis, treatment, or guidance. The information and features of the Service are intended to support and organize health/fitness routines. If you experience symptoms, health conditions, specific risks, pregnancy, or any relevant concerns, seek guidance from a qualified professional.

12) Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available"
• We do not guarantee that the Service will be uninterrupted, error-free, or suitable for a specific purpose
• We are not liable for indirect damages, lost profits, data loss, or damages resulting from misuse of the Service

Nothing in these Terms excludes consumer rights where applicable and cannot be excluded by law.

13) Suspension and Termination

We may suspend or terminate access/accounts at any time in cases of fraud or attempted fraud, violation of these Terms, abuse/harassment, spam, harmful behavior, risk to the Service's or third parties' security, or legal requirements. You may request termination/deletion per instructions in the app and/or via contato@nufocco.com.

14) Changes to Terms

We may update these Terms to reflect changes in the Service or legal requirements. When relevant, we will notify through available channels. Continued use of the Service after an update indicates agreement with the current version.

15) Applicable Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The jurisdiction of São Paulo/SP is elected, unless otherwise required by law.
